Alberta Skilled worker

The Alberta skilled workers category is a way for you to be nominated by the province of Alberta to apply for permanent residence in Canada as a skilled worker. You must fully demonstrate that you are a qualified ‘skilled worker’ and intend to work and settle in the province of Alberta. In order for you to apply under the Alberta skilled worker category you and your future employer must meet the Alberta Immigration Nominee Program (AINP) criteria. After you and your employer are deemed eligible the AINP will issue you a letter of nomination and your application will be processed by Citizenship and immigration Canada.

Here are the steps in the process:

1. Apply to the province to be nominated.
2. The province will assess whether you and your employer are eligible to be nominated.
3. If you are found eligible, the province will issue you a letter of nomination.
4. Apply to Citizenship and immigration Canada under the Provincial Nominee Program.
5. CIC will require you to undergo a Medical examination and they will perform a security background check. (Under the PNP category, CIC will only assess the applicant on medical examination and security background check and not on other grounds.)
6. CIC will issue you permanent residence status.

Please note: After you have been nominated by the province, you are eligible to apply for a temporary work permit until CIC makes a decision on your PNP application.

 

Eligibility Criteria for the AINP Skilled Worker Stream

You must:

•  Clearly show in your application that you intend to live permanently in Alberta;
• Have related education, training, work experience, and any Alberta licensing needed for the position to meet the AINP criteria;
• Provide a Copy of your valid work permit if you are already working in Alberta;
• Provide proof of your legal status in your country of residenceif you are not currently working in Canada.

If your occupation is early childhood educator and/or child care staff you must also meet the following additional criteria.

 

Additional Requirements for Employers of Early Childhood Educators and Child Care Staff for the Alberta Skilled Worker PNP

Alberta Employers of Early Childhood Educators must be accredited (or in the processing of getting accredited) with the Alberta Association for the Accreditation of Early Learning and Care Services and must be approved for funding under the Alberta Child Care Accreditation Funding Program.

If you are an Early Childhood Educator candidate, you must

• Hold a work permit under the NOC code 4214 and be currently residing in Alberta;
• Have completed at least secondary education;
• Be certified as a Child Development Worker (Level 2) or Child Development Supervisor (Level 3) by the Alberta Human Services’ Child Care Staff Certification Office;
• Have been employed in Alberta for at least of six (6) months with an accredited daycare program or family day home agency before you submit your AINP application.

 

Employer Criteria for the AINP Skilled Worker Stream

Your employer must:

• Be an incorporated or registered company in Alberta and operating as a business in Alberta (i.e. has an established production capability, plant or place of business in Alberta).
• Provide a job offer to you, the candidate, of a permanent (not contract) job with full time hours (at least 35 hours per week) in a skilled occupation.
  • A skilled occupation is an occupation that falls under one of the following categories in Canada’s National Occupational Classification (NOC) scheme:
    • NOC 0: which are management occupations which usually require at least one university degree (bachelors, masters or doctorate) or a professional designation from a professional regulatory body.
    • NOC A: which are occupations which routinely require at least university education.
    • NOC B: which are occupations which usually require college education (college is different from university in Canada).
  • The job offer must meet Alberta’s standards for salaries and for employment.
  • The job offer must not violate an existing collective bargaining agreement and it cannot be used to subvert a labour dispute.
• Provide proof of their authorization to hire you, i.e. a Labour Market Impact Assessment (LMIA) or proof that your job is exempt from the LMIA requirement.
• Show that the job offer complies with all the conditions of the LMIA (including your age), applicable. Note: If your occupation is exempt from an LMIA, the employer must show they are offering you wages and benefits which meet industry standards in Alberta. • Clearly show the need for your position and that your employer has made an actual, serious effort to hire a Canadian or permanent resident of Canada for your position first, but only if you are not currently working in Alberta (i.e. you are currently abroad).

 

Alberta Skilled Worker PNP Forms and Applications:

 

AINP Forms for the Skilled Worker Stream

As an applicant you are required to fill out these forms:

• AINP 003: Employer-Driven Application for Nomination
• AINP 008B: Candidate-Use of a Representative (if applicable)

 

IRCC Forms for the Alberta Skilled Worker PNP

If you receive a nomination, you will need to submit the following forms to Immigration, Refugees and Citizenship Canada.

• IMM 0008 Generic Application Form for Canada
• IMM 0008DEP Additional Dependents/Declaration Form (only complete if you have more than 5 dependants)
• IMM 0008 Schedule 4: Economic Classes: Provincial Nominees

You and your Spouse/common-law partner and any dependants over 18 must each complete the following IRCC forms.

• IMM 5669 Schedule A: Background/Declaration
• IMM 5406 Additional Family Information
• IMM 5476 Use of a Representative (if applicable)

 

Employer Forms for the AINP Skilled Worker Stream

Your Employer must fill out the following forms:

• AINP 005: Employer-Driven Application for a Skilled Occupation
• Employer Compliance Declaration Form if applying in an occupation in the foodservice industry
• AINP 008A: Employer – Use of a Representative (if applicable)

 

Please note:

• When sending supporting documents along with your application, make sure that they are certified.
• Send all of the AINP forms including employer forms and Copies only of the CIC forms and supporting documents to the AINP processing centre.
• Do not send the original CIC forms in your application to the AINP. You will send the originals to CIC after you have been nominated.
• Alberta does not charge fees for the process.
• You are required to pay the Citizenship and Immigration fees when submitting your application to the CIC. You can download the payment form from the CIC website.

 

AINP Fees

• Principal Applicant -$550
• Each accompanying family members who are 22 or older- $550
• Each accompanying family members who are less than 22 yrs of age -$150
• After Permanent residency is granted the principal applicant and each accompanying family member who is over the age of 22 yrs must pay the right of permanent residency fee -$490

Once you have completed all of the forms and gathered all the necessary documents, mail the application to the following address:
