Marriage to a Jordanian Citizen

Every country has laws that apply to its citizens marrying a person from a different country. Getting married to a Jordanian citizen with the goal of eventually bringing them to Canada to live is a process with many steps.

You must demonstrate to Jordanian officials that they are not currently married to anyone else – either you have never been married, or all divorces are finalized – that your identity is prove and that you have never committed any crimes in Jordan. This is done by providing various documents, including an Affidavit of Single Stat, to the Jordan government either in Jordan or via a Jordanian embassy.

If you want to bring your Jordanian spouse or partner to live in Canada, you must then file a sponsorship application for them to become a permanent resident. If they would like to visit you in Canada while their application is in process, they must also apply for a visitor visa. Jordanian Marriage Basic Requirements

In order to marry a citizen of Jordan, you must demonstrate to the Jordanian government that you are eligible to do so. This includes:

  • Proof of country of birth
  • Proof of single status
  • Proof of age requirement

 

Jordanian Marriage Ceremony

The marriage ceremony to a Jordanian citizen can legally take place in Jordan, Canada, or any other country as long as both parties have the necessary visas to enter this country legally. This marriage can then be recognized when applying for a permanent residence or a visitor visa for your Jordanian spouse. To learn more about ceremony customs, see below.

 

Family Members

If your Jordanian spouse has dependent children, this does not affect the Jordanian Marriage document application.

If you have dependent children, they have no effect on the application to marry a Jordanian citizen.

 

How long is the Jordanian Marriage document valid?

The document is valid for 6 months from the date of issue. If you do not marry your Jordanian fiancé within 6 months of the issuance of the Jordanian Marriage document, you must apply again with new supporting documents.

If you like traveling abroad and love shopping in the process like many Canadians, you must remember that there are set rules and regulations that you must follow, as well as duty you have to pay when you are bringing those goods across the Canadian border.

If you are a Canadian resident coming from Jordan, you are eligible for a personal exemption, which allows you to bring a certain amount of goods into the country from Jordan without paying any duty.

Personal exemptions

Personal exemptions are based on the amount of time you have spent in Jordan. These exemptions apply if:

  • You are a Canadian resident returning from a trip to Jordan
  • You are a former resident of Canada returning to live in the country from Jordan
  • You are a temporary resident of Canada.

If you were away on a trip to Jordan for at least 24 hours, you are allowed by law to claim goods worth up to $50 Canadian (excluding alcohol and tobacco) and if you were away for 48 hours, you are allowed to claim goods worth up to $200. If you were in Jordan for seven days, you can claim goods worth $750. Children and infants who  have also came back to Canada from a trip in Jordan are also eligible for personal exemptions; parents or guardians can make the declaration on behalf of the child, as long as the item is for the child’s use.

You are allowed by law to bring back any amount of goods into Canada from a trip in Jordan except for certain restricted goods such as explosives and Firearms. If the amount of items you bring into the country is more than that of your personal exemption, you are required by law to pay duty and any provincial or territorial assessments that apply as far as those goods are concerned. If the law has not conferred upon you any personal exception right, you will have to pay duty on the entire amount of the goods you bring in the country.

Gifts

You must declare all gifts to the Canada Border Services Agency. Gifts worth CDN $60 or less each may be brought into Canada duty-free and tax-free, but they must be declared. For gifts worth more than CDN $60, you may have to pay duties and taxes on the excess amount. Tobacco and alcohol cannot be imported as gifts.

Wedding gifts

If you got married in Jordan within three months before coming to Canada or if you plan to marry no later than three months after arriving in the country, you can bring in your wedding gifts free of duty and taxes. However, you must have owned and possessed the gifts while in Jordan and before you arrived in Canada. At this instance, the requirement to have used the goods does not apply. These same conditions apply to household goods you bring in as part of a bride’s trousseau from Jordan.

Ownership, possession and use requirements

To import goods duty- and tax-free, settlers must have owned,posseed and used the goods prior to their arrival in Canada and Former Residents must have owned, possessed and used the goods for at least six months before returning to resume residency from Jordan.

It is important that you meet these three requirements. For example, if you owned and possessed the goods without using them, the goods will be subjected to duty and taxes. Please note that leased goods are subject to duty and taxes because the Canada Border Services Agency does not consider that you own them. If you have bills of sale and registration documents, they can help you prove that you meet these requirements.

 

Exceptions to ownership, possession and use requirements

If you are a former resident then the six-month stipulation will be waived if you have been absent from Canada for five years or more. Therefore, you only need to have owned, possessed and used your personal and household effects/items for any period of time before you return to Canada from Jordan.

 

Replacement goods

Replacement goods imported by Former Residents from Jordan are also exempt from the six-month requirement. However, they must have owned, possessed and used the goods in Jordan before returning to Canada to resume residency. To qualify for the exemption, the goods must be replacements for goods that would have met the six-month ownership, possession and use requirements, except for the fact that they were lost or destroyed as a result of a fire, a theft, an accident or due to other unforeseen circumstances.

In addition, replacement goods must be of similar class and about the same value as the goods they are replacing. You will need to show proof in order to support your claim. If you intend to claim replacement goods and to ensure that they qualify, you should call the agency responsible for requirements.

Declaring your goods

You must give your list of goods to the border services officer when you arrive at your first point of entry in Canada from Jordan even if you have no goods with you at the time. The officer will complete a Form B4 , Personal Effects Accounting Document, assign a file number to it and give you a copy of the completed form as a receipt based on the list of goods you submit. To claim free importation of your unaccompanied goods when they arrive, you will need to present your copy of this form.  Goods to follow may be subject to import restrictions before you can import them.

To facilitate the clearance process, you can complete Form B4, before your arrival at the first port of entry in Canada. You can obtain a copy of the form from the Canada Border Services Agency’s web site at https://www.cbsa.gc.ca/

 

Disposing of goods you imported duty- and tax-free

If you import goods duty- and tax-free into Canada and if you sell or give the goods away within the first year of importing them into Canada, you will have to pay the applicable duty and taxes immediately. If you divert the goods for commercial use, the same rule applies.

How to Sponsor your spouse to Canada

Canadian citizen can sponsor a spouse and dependent children to come and live with them if they are outside Canada. Therefore Canadians are free to get a marriage visa to marry their Jordanian spouses and sponsor their application for marriage immigration to Canada provided that they meet all the requirements set forth by the Canadian Government. If you were married in Jordan the marriage must be valid under the Jordanian law and under the Canadian law.  A marriage performed in a Canadian Embassy in Jordan must comply with the laws of Jordan.

 Requirements a Canadian must meet in order to Sponsor his Spouse from Jordan to Canada

  • The Canadian immigration law requires that you must prove that you are a Canadian citizen or a legal permanent resident of Canada and  of age 18 years or over in order to qualify to sponsor your Jordanian spouse to Canada
  • The Canadian immigration law requires you as a Canadian citizen and as a sponsor of your Jordanian spouse,  you must prove that you are financially stable in order to support her for 3 years after she attains her permanent residency
  • The immigration law further requires that if you as a Canadian citizen have dependent children with your Jordanian spouse, you must also support them for 10 years or until they are 25 years of age
  • The law requires that you must prove that you have adequate housing where you, your Jordanian spouse and any dependent children can live without relying on state assistance
  • The law also demands that as a Canadian citizen and as a sponsor, you must prove that you did marry your Jordanian wife in Jordan and intend to live in Canada with her.
  • The Canadian immigration law further requires that as a Canadian citizen and also as a sponsor, You must prove that you are not on any Social Assistance program provided by the government
  • The immigration law also requires that as a Canadian citizen and as a sponsor you  must prove that you are not in any way breached  any previous sponsorship agreement

 The Canadian Immigration law may deny a Canadian citizen his/her right to sponsorship under the following circumstances.

  • The law may prevent a Canadian citizen from sponsoring his Jordanian spouse if he failed to provide financial support to his Jordanian spouse as he pledged when he signed  a sponsorship agreement
  • The law may also deny him this right if he previously breached the law by failing to support a dependent child as a result of a court order
  • The law may also deny him this right if he received government financial assistance for reasons other than a disability. This amounts to fraud and consequently a breach of law
  • A Canadian citizen may be legally robbed of his sponsorship right if he was previously convicted of an offence of a sexual nature, a violent crime, an offence against a relative that results in bodily harm or an attempt or threat to commit any of such offences.
  • The law may also deny him the sponsorship right if he previously sponsored as another spouse, common-law or conjugal partner and  the said person became a permanent resident of Canada less than 5 years ago
  • The law can also deny a Canadian citizen his right of sponsorship if he defaulted on an immigration loan, delayed in payment or missed payments as stipulated by the law
  • The law may also deny a Canadian citizen his right to sponsor his Jordanian spouse if he has been legally declared bankruptcy.

If you live in Quebec, you must also meet Quebec’s immigration sponsorship requirements, after Citizenship and Immigration Canada approves you as a sponsor

Permanent Residence Application

How a Spouse and dependent children can get permanent resident status

For a spouse or a dependent child (s) to get a Canadian permanent resident through a sponsor, they have to submit application according to the Canadian immigration law

The application process involves two parts:

If you are a citizen or permanent resident of Canada, you must apply to sponsor them.

Your spouse or dependent children must also apply for permanent residence.

If you sponsor your spouse and your dependent children as a group, all of their applications for permanent residence must be filled out at the same time to be mailed together.

The applications for both sponsorship and permanent residence should be filled out and sent at the same time. There are two steps to process the application forms:

The sponsorship application is processed by the Case Processing Centre (CPC) in Mississauga, Ontario (for family members living outside Canada), or the CPC in Vegreville, Alberta (for family members living inside Canada).

If you are approved as a sponsor, the permanent residence application is sent to the appropriate Canadian visa office.

If you live in Quebec, you must also meet Quebec immigration sponsorship requirements.

Application Process

Obtaining an application package

You will need an application package for sponsorship and an application package for permanent residence for your spouse or dependent child.

Depending on whether your spouse is in Jordan or live in Canada, the application packages for sponsorship and permanent residence are different. Be sure to choose the correct application package. For instance:

If your spouse or accompanying dependent child lives with you in Canada, use the Application for Permanent Residence in Canada—Spouse or Common-law Partner.

If your spouse, partner or dependent child lives in Jordan, use the Application to Sponsor a Member of the Family Class.

Complete the application forms and attach the necessary documents.

Be sure to provide all the documents listed in the Document Checklist. If information or documents are missing, your application may be delayed.

As the sponsor, you will sign an agreement that commits you to supporting your Jordanian spouse for three years. If you sponsor a dependent child, you will commit to supporting the child for 10 years or until the child is 25 years old, whichever comes first.

  • Your Jordanian spouse must promise to make every effort to become self-supporting.
  • If you sponsor your dependent children who are not accompanying your Jordanian spouse, you will have to complete a separate application and pay the applicable fees for each of these children.
  • You must ensure that your Jordanian spouse and children if any that you are sponsoring completes the application for permanent residence.
  • You must ensure that your Jordanian spouse and dependent children if any that you want to sponsor completes the medical examination requirements. Instructions are in the application package.

Assemble the final application for permanent residence, including applications, supporting documents, and proof that the medical examination has been done.

 

Pay the fee and get the necessary receipt.

The application processing fee is payable in Canadian funds only.

Payment of fees on the Internet is the preferred method of payment.

The Spouse’s visa application fees are as follows:

  • $75 for you as a sponsor
  • $475 for your Spouse
  • $150 for a dependent child your wife who is under 22 and not married
  • $550 for a dependent of your wife who is 22 or older, or who is under 22 and married $490 for the right of permanent residence fee which your spouse will have to pay before the status is granted.

In order to successfully pay your fees using the internet, you need a VISA or MasterCard.

If you live in Jordan, you are able to pay your fees using the Internet or you can also obtain an international money order or bank draft. You must ensure that the money is in Canadian dollars and must be payable to the Receiver General for Canada. You must ensure that you made the payment right by ensuring that on the front of the money order or draft, you have written the financial institutions’ name, complete address (not a post office box number) and account number(s). After this is done, you can now submit the money order or draft with your application.

5. Mail the application and documents.

The application package has the address you need for mailing your application to the Case Processing Centre (CPC) in Mississauga, Ontario (for family members living in Portugal) or CPC in Vegreville, Alberta (for family members living inside Canada). The application assessment process

The Case Processing Centre in Mississauga (CPC-Mississauga) will review your sponsorship application. If it is approved, your spouse or relative’s application for permanent residence will be forwarded to the visa office responsible for their home country or the country where they have lived for more than one year.

You, the Sponsor, will be notified in writing of the decision and of the visa office to which your spouse’s application has been sent.

CPC-Mississauga will inform you whether or not your sponsorship application is approved. If you do not meet the sponsorship requirements (mentioned above), the spouse you want to sponsor may continue with their application for permanent residence, but it may not be approved. If you are approved as a sponsor, but the application of the spouse you are sponsoring is refused, you will receive the reason for the refusal and information about appeal rights.

You may withdraw your sponsorship application at any point in the process before the relative or spouse you are sponsoring are issued permanent resident visas. You may be eligible for a refund of the sponsorship fee and/or the permanent resident application fees if processing of your application has not yet begun.

 

How to check the Status of your Application

To check the status of your application, you will need your Unique Client Identifier (UCI) or Application Number which will be on any correspondence you receive from IRCC)

When to contact IRCC

You must notify IRCC of any changes in your application, such as:

  • Changes in your personal circumstances such as a birth or adoption of a child, or a divorce,
  • Change in contact information (email, mailing address, phone number),
  • Appointment or change of immigration representative or designated individual, or,
  • Decision to withdraw your application.

How to contact IRCC

To change contact information: Please use IRCC’s online form to change your contact information. Do not send change of address information to CPC-Mississauga, it will not be acknowledged and your contact information will not be updated. This could lead to a delay in processing your application.

Registration of Marriage in Jordan

There are no civil ceremonies performed in Jordan.Marriage in Jordan is administered by religious authorities of the different religious communities. There is no civil marriage. Practices governing marriage contracts vary from community to community and you should consult an official of the Islamic Shari’a court or of the appropriate Christian church if you have specific problems or questions.

If you plan to marry in Jordan you should be prepared to prove that you are not currently married. If you have been married previously, you must have a divorce certificate. If you have never been married, you may be required to provide a document from a civil or religious official of your normal place of residence stating that you are not married. The Canadian Embassy cannot provide you with such a document. However, if you make out an affidavit affirming your single status, the Embassy can notarize your statement. This is often acceptable in local marriage courts.

Certificate of No Impediment

If you are getting married in a church in Jordan you will need to provide a Certificate of No-Impediment. The embassy can help you with this.

For the Certificate No Impediment you must come to the Embassy in Amman to post your bans.  You will need to give notice that you intend to marry. You will need to bring with you:

  • Both applicants’ passports showing Jordanian entry stamps (you must have been resident in Jordan for a clear 21 days)
  • Both applicants’ long form birth certificates (which include names of both parents).
  • Original Canadian divorce documents

You will swear an oath to the effect that there is no impediment to your marriage. The notice is displayed in the Consulate for 21 days and if no legal impediment to the marriage has been shown to exist, the certificate is issued.

If you are getting married in the Sharia Court, you may be asked to provide a declaration that you are free and single to be married. You will need to bring with you the following documents;

  1. Your Canadian passport
  2. Original divorce documents (if applicable)

You will need to make the declaration in front of a Consular Officer who will then sign the declaration. This can be completed the same day.

If you are resident in another country and wish to marry in Church, you must give notice to your local Embassy in your country of residence. Your certificate will be issued by the Embassy in Jordan.

Jordanian Money

The dinar is the currency of Jordan. The dinar is divided into 10 dirham, 100 qirsh (also called piastres) or 1000 fils.

The Jordanian dinar continued to be used in the West Bank along with Israeli currency after Israel took control of it in 1967. During Israel’s hyperinflation in the 1970s and 1980s, the Jordanian currency provided stability.

Brief History of Jordanian Money

From 1927 to 1950, the Palestine Currency Board issued Palestinian pounds as the official currency in both Palestine and the Trans-Jordan Emirate. After Jordan became an independent kingdom on 25 May 1946, the idea of issuing a national currency arose and led to the passing of the Provisional Act No. 35 of 1949. Under this Act, the Jordan Currency Board was formed, which became the sole authority entitled to issue Jordanian currency in the kingdom. The London-based entity consisted of a president and four members. As of 1 July 1950, the Jordanian dinar became the kingdom’s official currency, and use of the Palestinian pound ceased in the kingdom on 30 September 1950. Although issued by the Jordan Currency Board, the notes bear the name of The Hashemite Kingdom of the Jordan.

Until 1992, coins were denominated in Arabic using fils, qirsh, dirham and dinar but in English only in fils and dinar. Since 1992, the fils and dirham are no longer used in the Arabic denominations and the English denominations are given in dinar and either qirsh or piastres.

Coins

Coins were introduced in 1949 in denominations of 1, 5, 10, 20, 50 and 100 fils. The first issue of 1 fils was mistakenly minted with the denomination given as “1 fil”. 20 fils coins were minted until 1965, with 25 fils introduced in 1968 and ¼ dinar coins in 1970. The 1 fils coin was last minted in 1985. In 1996, smaller ¼ dinar coins were introduced alongside ½ and 1 dinar coins.

Banknotes

In 1949, banknotes were issued by the government in denominations of 500 fils, 1, 5, 10 and 50 dinar. From 1959, the Central Bank of Jordan took over note production. 20 dinar notes were introduced in 1977, followed by 50 dinar in 1999. ½ dinar notes were replaced by coins in 1999.

The Jordanian 1 dinar Banknote depicts on the front, Sharif Hussein bin Ali who was the Sharif and Emir of Mecca from 1908 until 1917, when he proclaimed himself and was internationally recognized as King of the Hejaz.  On the back it depicts the Great Arab Revolt which was initiated by the Sherif Hussein bin Ali with the aim of securing independence from the ruling Ottoman Turks and creating a single unified Arab state spanning from Aleppo in Syria to Aden in Yemen.

 

5 dinars

The Jordanian 5 dinars depicts on the front, Abdullah bin al-Hussein who was the second of three sons of Sherif Hussein bin Ali, Sharif and Emir of Mecca and his first wife Abdiyya bint Abdullah. On the back it depicts Ma’an Palace

The Jordanian 10 dinars depicts on the front, Talal bin Abdullah who was King of Jordan from 20 July 1951 until forced to abdicate in favour of his son Hussein due to health reasons on 11 August 1952.

 

 

 

20 dinars

The Jordanian 20 dinars depict on the front, Hussein bin Talal who was King of Jordan from the abdication of his father, King Talal, in 1952, until his death. Hussein’s rule extended through the Cold War and four decades of Arab-Israeli conflict. On the back it depicts Dome of the Rock which is a shrine located on the Temple Mount in the Old City of Jerusalem.

 

50 dinars

The Jordanian 50 dinars depict on the front, King Abdullah II bin al-Hussein who is the reigning King of the HashemiteKingdom of Jordan. He ascended the throne on 7 February 1999 upon the death of his father King Hussein. On the back it depicts Raghadan Palace

 

Wedding Traditions in Jordan

Getting married and having children are top priorities in Jordan. Many marriages in Jordan continue to be arranged marriages.  Most marriages are arranged by the father of the bride. However that is not to say that the bride or groom does not get a choice in the matter.  They do.  But if a bride and groom are brought together through family it is rare for either to reject the match.  An arranged marriage in Jordan is usually made through the bride or groom’s circle.  Matches are generally arranged through women in the family and being a conservative society, matches will be made through families already known to the women.  First cousin and second cousin marriages continue in Jordan.  In other cases marriages will be arranged through families who have married in to the women’s circle of contacts.

 

Often cousins marry each other, and the couple may barely know each other until the engagement is announced. The wedding has two celebrations: an engagement party and a wedding party. After the engagement party, the process of dating and getting to know each other begins. Sometimes the young couple are given a short period of time they are allowed to talk during the engagement party.  Usually both the young man and woman have questions prepared they wish to ask.  By the end of the meeting the couple generally decides whether they wish to marry.  Most couples do agree to marry and are now engaged.

 

After the engaged woman and man have signed the papers at the engagement party, they are legally married. If they choose not to proceed, even though they have not lived together, they must divorce. Brides must be virgins on the wedding night. A couple may be engaged for a period of several weeks or for a period of several years.  That depends on the families.  During the engagement period some couples may receive further opportunities to get to know one another; others may not.  Generally, it can be said that how much contact or if any contact prior to the marriage is dependent on the families and how open they are with each other.

 

A small ceremony would take place before the actual celebrations some time before where the marriage would be solemnized before a religious Sheikh who is an Islamic magistrate with three witnesses all male or two female and one male .The groom is inquired of what he is giving to the bride for her hand in marriage as a token of appreciation and gift. The Celebrations would be held in some grand hotel with fabulous arrangement or at any place selected by the bride and groom. There would be separate seating arrangement of the ladies and gents. Many a times the groom would be with his friends separately with all the songs and traditional singing going on and the after the feast the couples would be escorted to a place where they would sit together amid relatives and friends.

 

After marriage, every aspect of a woman’s life is dictated by her husband. She cannot obtain a passport or travel outside the country without his written approval. At any time, a husband may take another wife. Polygamy with up to four wives is legal. Divorce is legal. When there is a divorce, custody of the children automatically goes to the father, and for this reason, women choose to remain in a marriage even when there are other wives. Divorced women are viewed as outcasts in Jordan.

 

Jordanian Cuisine

Most meals include meat and bread, along with vegetables and fruits that are in season. There are many types of bread; the most common is flat and round. The national dish of Jordan is mansaf, a large tray of rice covered with chunks of stewed lamb (including the head) and jameed (a yoghurt sauce). It is eaten by hand from the serving tray. Other popular dishes include mahshi (stuffed vegetables); sakhan (chicken with onions, olive oil, pine nuts, and seasonings), and meshwi, or shish kebab. Common vegetables include tomatoes, onions, eggplant, and cabbage. Lamb and chicken are the most common meats. Observant Muslims do not eat pork or drink alcohol.

It is traditional to eat food only with the right hand. When being entertained in someone’s home, it is polite for guests to leave a little food on their plate to indicate that they have been generously provided for. Coffee is important at any meal. Qahwah Saadah (Bedouin coffee) is bitter and drunk slowly from small cups. Arabic or Turkish coffee is sweeter; it is not stirred, so as to keep the thick grains at the bottom of the cup.
